Referate - Terms of Service

Welcome to Referate, published by Elmvick Software. By downloading, accessing, or using Referate, you agree to these Terms of Service. If you do not agree, do not use the app.

1. Purpose of the App

Referate is an academic assistance app that helps users create reports, essays, presentations, theses, study summaries, possible oral-defense questions, and export-ready materials with AI-assisted research and drafting.

2. Academic Integrity

Referate is a tool for assistance, drafting, organization, study, and review. You are responsible for following the academic integrity rules, AI-use policies, citation rules, submission rules, and teacher or institution instructions that apply to your work.

You must not use Referate to cheat, impersonate authorship where that is prohibited, submit work in violation of your school rules, falsify research, fabricate data, misrepresent sources, or avoid required personal contribution.

3. AI-Generated Content

AI-generated content may be incomplete, inaccurate, outdated, duplicated, poorly cited, or unsuitable for your assignment. You must review, edit, verify, and adapt all output before using it. Referate does not guarantee originality, correctness, academic acceptance, grades, or compliance with any institution's rules.

When the app marks that student contribution is needed, you are responsible for adding real methodology, case-study information, personal analysis, data, interviews, surveys, or other required material that the AI cannot truthfully create for you.

4. Sources, Citations, and Research

Referate may suggest sources, citations, summaries, bibliographies, and research directions. You are responsible for checking that every source exists, is relevant, is allowed for your assignment, and is cited in the required format.

5. User Content

You are responsible for text, instructions, files, references, and other content you provide to the app. Do not upload or enter content that you do not have the right to use, content that is unlawful, or sensitive personal information unless it is necessary and you are allowed to process it.

You grant Elmvick Software the limited rights needed to process your content to provide the app, including storing project data, sending relevant prompts to backend services, generating drafts, and preparing exports.

6. Accounts, Access, and Subscription

Referate may use Firebase Authentication and anonymous account identifiers to protect access to projects and generation features. Some features may require an active subscription, including Referate Pro. Subscription purchase, renewal, cancellation, and refund handling may be managed through Google Play Billing and Google Play policies.

Generation access may be limited, suspended, changed, or unavailable if subscription verification fails, backend services are unavailable, abuse is detected, or the app is under maintenance.

7. Acceptable Use

You agree not to abuse the app, overload backend systems, bypass limits, attack or reverse engineer the service, submit unlawful or harmful content, attempt to access another user's projects, extract data in bulk, or use Referate in a way that violates law, platform policies, or these Terms.

8. Third-Party Services

Referate relies on third-party services such as Google Firebase, Google Cloud, Google Play Billing, and OpenAI. These services may be subject to their own terms, limits, outages, policies, and processing rules. Elmvick Software is not responsible for third-party service interruptions or policy changes.

9. Availability and Changes

Referate may change over time. Features, generation quality, export formats, subscriptions, prices, limits, models, providers, and platform availability may be added, changed, limited, interrupted, or discontinued.

10. Intellectual Property

Referate, the app design, branding, website, code, and related materials are owned by Elmvick Software or its licensors. These Terms do not give you ownership of the app or its underlying technology.

11. No Warranty

Referate is provided "as is" and "as available" without warranties of any kind. Elmvick Software does not warrant that the app will be uninterrupted, secure, error-free, accurate, suitable for your academic context, or accepted by any institution.

12. Limitation of Liability

To the maximum extent permitted by law, Elmvick Software shall not be liable for direct or indirect losses, including academic consequences, rejected submissions, incorrect citations, inaccurate output, missed deadlines, lost data, service interruptions, subscription issues handled by third parties, or reliance on AI-generated content.

13. Termination

We may suspend or limit access to Referate if we believe these Terms have been violated, abuse is occurring, security is at risk, or we are required to do so by law or platform policy.

14. Changes to These Terms

We may update these Terms from time to time. Updates will be published on this page with a revised last updated date. Continued use of Referate after changes are published means you accept the updated Terms.
